Terms & Conditions

1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your use of the Legit Boet mobile application and any related services (collectively, the "Service") provided by LalaLand Studios, operated by Illana De Beer, Oberdreisbach-Hohe 15, 53804 Much, Germany ("we", "us", or "our").

By downloading, installing, or using Legit Boet, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms apply to all users, including free-plan users, paid subscribers, and team members invited to an organisation.

2. Description of Service

Legit Boet is a construction site documentation tool designed for contractors, builders, subcontractors, and construction teams. The Service allows users to:

• Record daily site logs with GPS coordinates and timestamps
• Capture and store GPS-tagged photo evidence
• Create and manage work orders (variations) for additional works
• Obtain client electronic signatures on work orders via approval links
• Generate PDF evidence packages and final account documents
• Invite and manage team members with role-based access

Legit Boet is a documentation and record-keeping tool. It does not provide legal advice, financial advice, or any guarantee of legal outcomes. You are solely responsible for how you use the documentation generated by the Service.

3. Accounts and Registration

3.1 Account Creation

You must create an account to use Legit Boet. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at support@legitboet.site if you suspect unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your account.

3.3 One Account Per Organisation

Each organisation (company) may have one account. Team members are invited under the organisation's account. Sharing login credentials between multiple organisations is not permitted.

3.4 Age Requirement

You must be at least 18 years old to create an account. Legit Boet is a professional business tool and is not intended for use by minors.

4. Subscription Plans

Legit Boet offers the following subscription plans:

Plan features and pricing are subject to change. We will provide at least 30 days' notice of any price increases via email to your registered address.

4.1 Free Plan Limitations

The Free plan is limited to one active project. If you downgrade from a paid plan to Free, projects beyond the first will become read-only. No data will be deleted — you can access all your historical records but cannot add new entries to those projects until you upgrade again.

5. Billing and Payment

5.1 Payment Processor

All payments are processed securely by Stripe, Inc. Legit Boet does not store your payment card details. By subscribing, you also agree to Stripe's Terms of Service and Stripe's Privacy Policy.

5.2 Billing Cycle

Subscriptions are billed monthly on the same day of the month as your initial subscription date. Your subscription renews automatically unless cancelled before the renewal date.

5.3 Currency

Billing currency is determined at the time of subscription based on your selected market (South Africa = ZAR, Europe = EUR). Currency cannot be changed after subscribing without cancelling and resubscribing.

5.4 Taxes

Prices displayed may exclude applicable taxes (VAT, GST, or similar). Any applicable taxes will be shown at checkout and added to your subscription amount.

5.5 Plan Upgrades and Downgrades

Upgrades (e.g. Pro to Team) take effect immediately. Stripe calculates proration automatically — you will only be charged the difference for the remainder of the current billing cycle. Downgrades take effect at the end of the current billing period.

6. Payment Failures

If a payment fails (e.g. expired card, insufficient funds), the following applies:

• Stripe will automatically retry the payment according to its retry schedule
• You will receive one email notification of the failed payment
• If payment is not recovered, your account will be downgraded to the Free plan
• Your data is never deleted due to a payment failure — all records remain intact
• Once payment is recovered, your paid plan is restored automatically

To update your payment method, go to Profile → Manage Subscription → Billing Portal within the app.

7. Cancellation

7.1 How to Cancel

You may cancel your subscription at any time through the app: Profile → Manage Subscription → Billing Portal → Cancel Subscription. You may also cancel directly through your Apple App Store or Google Play Store subscription settings.

7.2 Effect of Cancellation

Upon cancellation, your paid plan remains active until the end of the current billing period. After that, your account reverts to the Free plan. No data is deleted upon cancellation.

7.3 Account Deletion

If you wish to delete your account entirely, contact us at support@legitboet.site. Account deletion is permanent and irreversible. All your data will be permanently removed within 30 days of your request.

8. Refund Policy

Subscription fees are non-refundable except in the following circumstances:

• You were charged in error (duplicate charge, technical fault on our side)
• The Service was unavailable for more than 72 consecutive hours due to issues on our side
• You are entitled to a refund under applicable consumer protection law in your jurisdiction

To request a refund, contact support@legitboet.site within 14 days of the charge in question. We will review each request on a case-by-case basis.

If you subscribed via Apple App Store or Google Play, refund requests must be directed to Apple or Google respectively — we do not control their refund processes.

9. Electronic Signatures and Legal Compliance

9.1 Work Order Approvals

Legit Boet's work order approval system allows clients to provide electronic signatures via a secure approval link. The approval process captures:

• The client's typed full name (as a legal signature)
• An explicit confirmation checkbox
• Timestamp of the signature
• IP address of the signing device
• A unique reference ID

9.2 Legal Standards

Legit Boet's electronic signature process is designed to comply with:

• ECT Act (South Africa): Electronic Communications and Transactions Act, 2002
• eIDAS (European Union): EU Regulation No 910/2014 on electronic identification and trust services

9.3 No Legal Guarantee

While Legit Boet creates a documented evidence trail, we do not guarantee the legal enforceability of any specific document or signature in any specific jurisdiction. The enforceability of electronic signatures depends on the laws of the relevant jurisdiction and the specific circumstances of each case. You should seek independent legal advice if you intend to use Legit Boet documentation in legal proceedings.

10. Acceptable Use

You agree not to use Legit Boet to:

• Falsify, backdate, or manipulate site logs, photos, or work orders
• Upload content that is illegal, defamatory, or infringes third-party rights
• Attempt to gain unauthorised access to other users' accounts or data
• Reverse engineer, decompile, or copy any part of the Service
• Use the Service for any purpose other than legitimate construction documentation
• Resell or sublicense access to the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these rules without notice or refund.

11. User Content

11.1 Ownership

You retain ownership of all content you upload to Legit Boet, including site logs, photos, work orders, and company information ("User Content").

11.2 Licence to Us

By uploading User Content, you grant us a limited, non-exclusive licence to store, process, and display your content solely for the purpose of providing the Service to you. We do not use your content for marketing, advertising, or any purpose beyond operating the Service.

11.3 Your Responsibility

You are solely responsible for the accuracy and legality of the content you upload. You confirm that you have the right to upload any photos, documents, or information you add to Legit Boet.

12. Data and Privacy

Your use of Legit Boet is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

We store your data on Supabase infrastructure hosted on AWS. Data is encrypted in transit (TLS) and at rest. We do not sell your data to third parties.

13. Intellectual Property

The Legit Boet application, including its design, code, branding, and content (excluding User Content), is the exclusive property of LalaLand Studios. Nothing in these Terms transfers any intellectual property rights to you. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

14. Third-Party Services

Legit Boet integrates with the following third-party services:

We are not responsible for the practices of these third-party services. Your use of these services is subject to their own terms and privacy policies.

15. Availability and Uptime

We aim to keep Legit Boet available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will notify users in advance where possible)
• Unplanned outages caused by third-party infrastructure (Supabase, AWS)
• Force majeure events beyond our control

We are not liable for any loss or inconvenience caused by temporary unavailability of the Service.

16. Limitation of Liability

To the maximum extent permitted by applicable law:

• Legit Boet is provided "as is" without warranty of any kind, express or implied
• We do not warrant that the Service will be error-free, uninterrupted, or fit for any particular purpose
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 3 months preceding the claim

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

17. Disclaimer

Legit Boet is a documentation tool. We make no representation that:

• Documents generated by Legit Boet will be accepted as evidence in any court or arbitration
• Electronic signatures obtained through Legit Boet will be enforceable in every jurisdiction
• Using Legit Boet will prevent or resolve any specific dispute

Always consult a qualified legal professional before relying on any document as legal evidence.

18. Indemnification

You agree to indemnify and hold harmless LalaLand Studios, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service in violation of these Terms
• Any User Content you upload that infringes a third party's rights
• Any dispute between you and a third party (including your clients or subcontractors)

19. Termination

19.1 By You

You may stop using Legit Boet and cancel your subscription at any time. See Section 7 for cancellation details.

19.2 By Us

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Use the Service fraudulently or for illegal purposes
• Fail to pay subscription fees and do not remedy the failure within 14 days of notice

In the event of termination by us for cause, no refund will be issued. In the event of termination without cause, we will refund any unused portion of your current billing period.

19.3 Effect of Termination

Upon termination, your access to the Service ends. You may request an export of your data before your account is deleted. Data will be permanently deleted within 30 days of account termination.

20. Governing Law and Dispute Resolution

20.1 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

20.2 Jurisdiction

Any disputes arising from these Terms or your use of Legit Boet shall be subject to the exclusive jurisdiction of the courts of Cologne, Germany.

20.3 EU Consumer Rights

If you are a consumer resident in the European Union, you may also have rights under the consumer protection laws of your country of residence. Nothing in these Terms affects your statutory rights as an EU consumer.

20.4 Informal Resolution

Before initiating any formal legal proceedings, we encourage you to contact us at support@legitboet.site to attempt to resolve the matter informally. We will make good-faith efforts to resolve any dispute within 14 business days.

21. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Send an email notification to your registered email address
• Display an in-app notice on your next login

Your continued use of Legit Boet after the effective date of updated Terms constitutes your acceptance of the changes. If you do not accept the updated Terms, you must stop using the Service and cancel your subscription.

22. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LalaLand Studios regarding the use of Legit Boet, and supersede all prior agreements, understandings, or representations.
